Alabama has been given the green light to proceed with the execution of Kenneth Eugene Smith using nitrogen gas, a method that has not been previously employed for capital punishment.
Smith had requested the court’s intervention, arguing that the administration of toxic nitrogen through a mask was a form of cruel and unusual punishment.
The execution is set to take place on Thursday.
Smith’s previous execution attempt in Alabama occurred two years ago, as punishment for his 1989 murder conviction.
